Terms of Service

These Terms of Service (“Terms”) govern your use of the Persona Engine platform operated at timbre.fyi(“Service”). By using the Service, you agree to these Terms.

1. Service Description

Persona Engine is a managed social media automation platform. We provide AI-powered content creation, publishing, and engagement tools for the Threads platform. The Service runs on dedicated infrastructure provisioned for each customer.

2. Account Requirements

  • You must be at least 18 years old
  • You must provide accurate account information
  • You are responsible for maintaining the security of your account credentials
  • You must own or have authorized access to the social media accounts you connect

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Violate the terms of service of connected platforms (Meta/Threads)
  • Impersonate real individuals without their consent
  • Generate or distribute harmful, abusive, or illegal content
  • Spread medical misinformation, health advice, or diagnostic claims
  • Harass, threaten, or harm other users or platform participants
  • Engage in spam, fraud, or deceptive practices
  • Attempt to circumvent safety filters or content guardrails

4. Social Media Platform Compliance

The Service uses the official Threads API (by Meta) to publish content, manage replies, and retrieve analytics on your behalf. You acknowledge that:

  • You authorize us to use the Threads API with the permissions you grant during the OAuth connection flow
  • Published content is subject to the platform’s community guidelines and terms of service
  • You are ultimately responsible for the content published under your account
  • We implement rate limiting and content safety measures in compliance with platform guidelines

5. AI-Generated Content

Content created by AI agents is generated based on your persona configuration, content pillars, and voice settings. You acknowledge that:

  • AI-generated content may require review and editing before publication
  • We provide safety filters but cannot guarantee all generated content is appropriate
  • You retain ownership of published content and are responsible for its accuracy

6. Subscription and Payment

  • The Service is offered on a subscription basis with plans as described on our pricing page
  • Payments are processed by Paddle, our merchant of record
  • Subscriptions renew automatically unless cancelled before the billing date
  • Refunds are handled on a case-by-case basis within 14 days of purchase

7. Your Credentials and Keys

You provide social media credentials and AI API keys to operate the Service. We:

  • Encrypt all credentials at rest using AES-256-GCM
  • Store credentials on your dedicated server instance only
  • Use credentials solely for authorized operations on your behalf
  • Never access your credentials for any other purpose
  • Delete all credentials when you cancel your subscription

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Each customer’s data is hosted on an isolated VPS instance. We do not share customer data between accounts.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party platform changes, and unforeseen issues may cause temporary disruptions. We will notify you of planned maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Persona Engine shall not be liable for:

  • Loss of social media accounts due to platform enforcement
  • Inaccurate or inappropriate AI-generated content
  • Service interruptions or data loss
  • Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

You may cancel your subscription at any time through the dashboard. We may suspend or terminate your account if you violate these Terms. Upon termination, we will delete your data as described in our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or dashboard notification. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
